LITIGATION SERVICES
General Commercial & Employment Litigation The firm handles a
wide range of Federal and State litigation matters that arise in the
commercial context: copyright infringement, trademark infringement, rights
of privacy and publicity, domain name disputes, First Amendment, contract
claims, employment disputes including ERISA litigation, equitable
accountings, royalty disputes, and fee and commission disputes.
Intellectual Property Litigation The firm litigates in
copyright and trademark policing and infringement actions. Dowd & Marotta
LLC has obtained numerous favorable Federal court decisions in copyright
infringement and breach of contract actions. Other matters include domain
name disputes, trademark cancellation, unfair competition, anti-dilution,
defamation, and trade secrets. Clients include Internet content providers,
cable television channels, fashion photographers, modeling agencies based
in New York and Milan, banks and manufacturing companies.
Media Litigation The firm serves as litigation
counsel in all matters related to traditional media, i.e., film,
television, magazine publishing, record companies and music distributors,
covering areas such as contract disputes, royalty accountings, defamation,
First Amendment, rights of privacy and publicity, copyright infringement,
and trademark infringement.
Real Estate, Construction and Demolition Litigation
Protection of collateral by debt collection counseling and institution of
foreclosure actions is provided on behalf of individual and institutional
lenders in both residential and commercial transactions. Other matters
include cooperative, condominium and homeowner association claims,
insurance claims, and commercial lease disputes. Recent construction and
demolition cases include the Taft Hotel conversion litigation, in which
the firm won summary judgment for an architect defendant (Supreme Court,
New York County, Cozier, J.), the Stanton Street demolition (U.S. District
Court for the Southern District of New York, Berman, J.), the
Irreplaceable Artifacts demolition, Stapleton Studios and numerous other
land disputes involving liens, easements, land use, economic development,
and other title issues. The firm performs a significant volume of work
pro bono in these areas for not-for-profit clients, such as the
enforcement and collection of secondary liens. Clients include the
Business Loan Center, Inc. (SBA lender), Neighborhood Housing Services of

Appellate Litigation The firm handles appeals
to the New York State Court of Appeals, the Appellate Divisions of the
